DMCA Policy

Russell Questiona Red Bull ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Russell Questiona Red Bull website or online services (the "Service") if such claims are reported to our Designated Copyright Agent identified below.

Filing a DMCA Takedown Notice

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Service by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent. Upon receipt of the Notice as described below, Russell Questiona Red Bull will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the Service.

Your DMCA Notice of Alleged Infringement must be provided in writing and include substantially the following:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest.
  2. Identification of the copyrighted work or other intellectual property that you claim has been infringed.
  3. Identification of the material that you claim is infringing and where it is located on the Service (e.g., URL of the specific page or content).
  4. Your address, telephone number, and email address.
  5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.

Filing a DMCA Counter-Notification

If you believe that your material has been removed or disabled by mistake or misidentification, you may file a counter-notification with us by submitting written notification to our Designated Copyright Agent identified below. Pursuant to the DMCA, the Counter-Notice must include substantially the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which Russell Questiona Red Bull may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
